Uninsured Drivers’ Claims

Hit and Run and Untraced Drivers’ Claims

An increasing number of drivers simply fail to stop after involvement in an accident, leaving the scene before they can be traced. Others give false particulars, especially if they are driving a stolen vehicle. Section 170 of the Road Traffic Act 1988 requires a driver to stop when involved in a road accident resulting in injury to someone else or damage to his or her vehicle. That driver must also give details of his or her name, address and vehicle registration number, if requested on reasonable grounds; otherwise he or she should report the accident to the police. Failure to do so is an offence. Clearly, if a driver fails to stop these particulars cannot be ascertained and no civil claim can be brought. This presents an obvious predicament for road users who have suffered injury or other loss or damage as a result of a hit and run or untraced driver. Pursuing a civil claim against a hit and run or untraced driver is not possible, because there is no identifiable defendant. Fortunately, it is possible to apply for compensation from the Motor Insurers’ Bureau under the Untraced Drivers’ Agreement.
It is very important to report any hit and run or untraced driver’s accident to the police within 24 hours from the time of accident as failure to do so can cause difficulties in making a claim through Motor Insurer’s Bureau.
Unfortunately, in claims to the Motor Insurers’ Bureau (MIB) full legal fees are not recoverable for untraced cases. In those cases we may agree to enter into a contingency agreement with you. Under such agreement if your claim was successful then a percentage would be deducted from your damages in respect of our legal fees and disbursements. If your MIB untraced claim was unsuccessful we would not charge you anything for the work done. We will agree with you what the percentage would be.

Since the first scheme was set up in 1964, the Authority has paid more than £3billion in compensation, making it among the largest and most generous of its type in the World. Its aim is to provide victims with material recognition of their pain and suffering and to allow society to express its regret to them.
Since April 1996 the level of compensation has been determined according to a scale, or tariff, set by Parliament. The scheme and the 1996 tariff was revised in 2001. The tariff includes descriptions of over 400 injuries, with each attached to one of 25 levels of compensation between £1,000 and £250,000.
There is a time limit of 2 years to make a claim and certain conditions must be met in order for there to be a prospect of you being awarded compensation.

It is not essential that you have a Lawyer to represent you and you can in fact make an application yourself directly to the Criminal Injuries Compensation Authority. However, the Lawyers at Claim Today Solicitors do have considerable experience in making applications to the CICA on behalf of the victims of crime and we would be happy to discuss any such matter with you and provide you with free initial advice without any obligation.
